National Employment Registry — Terms of Use
1. Acceptance of These Terms
Welcome to the National Employment Registry (NER). The NER provides an online platform intended to facilitate access to employment opportunities, job seeker information, workforce resources, and related employment services. By accessing or using the NER, creating an account, submitting information, posting a job opportunity, searching for potential employees, or otherwise using any NER service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”) and any applicable policies incorporated by reference, including our Privacy Policy.
If you do not agree to these Terms, you must not access or use the NER.
2. Eligibility
You may use the NER only if you are legally permitted to enter into a binding agreement under applicable law. Employers and other organizations using the NER must ensure that their representatives are authorized to act on their behalf. You are responsible for ensuring that your use of the NER complies with all applicable federal, state, local, and other laws and regulations.
3. Permitted Use
The NER is intended to support legitimate employment-related activities.
Job seekers may use the NER to:
- Search for employment opportunities;
- Create and maintain an employment profile and résumé;
- Communicate with participating employers;
- Access employment-related resources made available through the NER.
Employers and authorized recruiters may use the NER to:
- Post legitimate employment opportunities;
- Search for and evaluate candidates for genuine employment purposes;
- Communicate with applicants concerning employment opportunities;
- Manage recruitment activities associated with their organization.
Use of the NER is a limited, revocable privilege and is subject to these Terms.
4. Accuracy of Information
You agree that information you provide to the NER will be accurate, current, and complete to the best of your knowledge.
Job seekers are responsible for the accuracy of information contained in their profiles, résumés, applications, credentials, employment history, education, certifications, and other submitted materials.
Employers are responsible for ensuring that registration information is accurate, any job postings accurately describe the position, compensation, qualifications, location, working conditions, and other material terms of employment.
The NER may remove or request correction of information that it reasonably believes is inaccurate, misleading, fraudulent, or otherwise inconsistent with these Terms.
5. Prohibited Uses
You may not use the NER to:
- Post fraudulent, fictitious, misleading, or incorrect information;
- Impersonate another person, employer, organization, or government agency;
- Misrepresent your identity, qualifications, employment history, or authority;
- Collect information for purposes unrelated to legitimate employment activities;
- Engage in discrimination prohibited by applicable law;
- Harass, threaten, abuse, or intimidate another user;
- Send spam, unsolicited bulk communications, phishing attempts, or other unauthorized communications;
- Use information obtained through the NER to commit fraud, identity theft, or other unlawful activity;
- Scrape, harvest, copy, reproduce, sell, redistribute, or commercially exploit NER information except as expressly authorized;
- Circumvent security measures or attempt to gain unauthorized access to accounts, systems, or data;
- Introduce malicious software, code, or other harmful material;
- Interfere with the operation or security of the NER;
- Use the NER for any purpose that violates applicable law or these Terms.
6. Employer Responsibilities
Employers and recruiters must use candidate information solely for legitimate employment-related purposes and in accordance with applicable privacy, employment, anti-discrimination, and data-protection laws. Employers must not require applicants to provide information that they are prohibited from requesting under applicable law. Employers are responsible for reviewing applicants and making hiring decisions. The NER does not guarantee that any particular candidate is qualified, available, or suitable for a particular position.
7. Job Seeker Responsibilities
Information that a job seeker voluntarily includes in an active profile may be viewed by users with employer accounts. Job seekers should treat all information included in their profiles as publicly accessible and should not include Social Security numbers, birth dates, financial information, government identification numbers, or other sensitive personal information.
Job seekers should exercise appropriate caution when communicating with employers and should not provide sensitive personal information unless it is reasonably necessary and appropriate for the employment process.
The NER does not guarantee that any employer, job posting, or employment opportunity will result in an interview, offer, or employment.
Users should independently evaluate the identity and legitimacy of other users and employment opportunities.
8. Privacy and Personal Information
Information that a job seeker voluntarily includes in an active profile may be viewed by users with employer accounts. Job seekers should treat all information included in their profiles as publicly accessible and should not include Social Security numbers, birth dates, financial information, government identification numbers, or other sensitive personal information.
Information submitted through the NER may include personal and employment-related information. Such information will be collected, used, disclosed, and retained in accordance with the NER Privacy Policy and applicable law. Users should review the Privacy Policy before submitting personal information. Where required by law, appropriate safeguards, notices, consent mechanisms, access rights, correction procedures, and data-retention practices will apply to personal information maintained by the NER.
9. User Accounts and Security
Where registration is required, you are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account, except to the extent caused by the NER’s own failure to maintain appropriate security. You must promptly notify the NER if you believe your account has been compromised or used without authorization. You may not share, transfer, or permit others to use your account.
10. User-Submitted Content
You retain ownership of materials that you lawfully submit to the NER, subject to the rights necessary for the NER to operate its services. By submitting a résumé, profile, job posting, or other material, you grant the NER the limited rights necessary to store, process, display, transmit, and otherwise use that material for the purposes of providing and administering the NER and its services. You represent that you have the necessary rights and authority to submit the material and that its submission and use by the NER as permitted by these Terms will not violate applicable law or the rights of another person.
11. Intellectual Property
The NER and its content, software, designs, logos, databases, text, graphics, and other materials are owned by or licensed to the NER and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not reproduce, modify, distribute, publicly display, sell, license, or otherwise exploit NER materials without prior written authorization.
12. Third-Party Services and Information
The NER may contain links to or integrations with third-party websites, services, employers, or resources. The NER does not necessarily endorse or control third-party services and is not responsible for their content, availability, privacy practices, or terms of use. Your use of third-party services may be subject to additional terms established by those third parties.
13. No Guarantee of Employment
The NER is intended to facilitate employment-related connections and access to information. It does not guarantee employment, interviews, hiring decisions, compensation, or the accuracy or availability of any particular job opportunity or candidate. Employers are solely responsible for their hiring decisions, employment practices, and compliance with applicable law.
14. Availability and Disclaimer
The NER will make reasonable efforts to maintain the availability and security of its services. However, the NER does not guarantee that the Service will always be uninterrupted, secure, error-free, or available. To the extent permitted by applicable law, the NER and its operators disclaim warranties, express or implied, concerning the NER and its content, including warranties of accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.
15. Suspension or Termination
We may suspend, restrict, or terminate your access to the NER if we reasonably believe that you:
- Have violated these Terms;
- Have provided false or misleading information;
- Have engaged in fraudulent, abusive, or unlawful conduct;
- Have compromised the security or integrity of the NER;
- Have otherwise misused the NER.
Where appropriate and permitted by law, we may also refer suspected unlawful activity to the appropriate authorities.
Termination or suspension does not affect provisions of these Terms that by their nature are intended to survive termination.
16. Changes to These Terms
We may modify these Terms from time to time to reflect changes in the NER, applicable law, security requirements, or our services. Updated Terms will be posted through the NER. The “Last Updated” date will identify the most recent version. Where required by law, we will provide additional notice of material changes. Your continued use of the NER after updated Terms become effective constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by the laws applicable to the NER and its administering authority, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute concerning the NER or these Terms shall be resolved in accordance with applicable law and any mandatory administrative or judicial procedures governing the NER.

19. Entire Agreement
These Terms, together with the NER Privacy Policy and any additional terms expressly incorporated by reference, constitute the agreement governing your use of the NER, except where a separate written agreement applies. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
